A Quick Guide to Registering Your Explorer Yacht in Jersey.

All yachts must have registration in a fixed jurisdiction, and our Explorer Yacht Vanguard is no exception. We initially envisaged a registration in the USA but changed our minds due to the impossibility of obtaining adequate insurance.

Our next choice was the Red Ensign of the UK and Commonwealth nations. I spent most of my sea time under the Red Ensign. I have a nostalgic connection. We chose Jersey Registry in the same way as Hull No 1 ( Mobius ). We were provisionally accepted by Pantaneous Insurance, who we discovered also insured Mobius and were familiar with the design and her performance.

Registering is not a complicated process but is also one where not many of us have much direct experience. So this is how we did it.

Ownership of our Explorer Yacht

Ownership - it is typical practice in the USA to keep significant assets in individual companies (LLC), locally known as "pass-through entities." This helps minimize collateral risks in the case of litigation. We used a local firm to register her with a single entity LLC in Newport, RI, USA.

Pre-approval

We then contacted the Jersey Small Ship Registry. The staff reply promptly and are a dream to work with, seeming well aware of the novice status of each applicant. The first step is to appoint a local representative.

We used Pierce Barker, a super nice chap, and completed form JR08 - "Appointment of a Local Representative."

You will then need to complete an application to register your chosen name using form JR01 - "Application to Register an Individual" OR JR01A - "Application to Register a Company." We did this, allowing us three months to arrange the correct documentation.

Form JR25 contains details of the applicable fees.

Note 1: they will need original wet ink copies of all documents submitted except the final JR10 - "Ships Carving and Marking Note."

Note 2: on this and subsequent forms, it is necessary to sign as the corporate body (owning the vessel) and the individual (possessing the Body Corporate or LLC). The two are the same signature but, in law, different entities.

Final Registry

The next act to organize is the Tonnage Survey.

Use the International Institute of Marine Surveying form, MCA-V8-09-10-18.

Tonnage Surveys are conducted by a surveyor approved and accepted by the Jersey Registry. We used Joe Rowles, our UK MCA surveyor appointed by the British Government (UK MCA) and, by default, acceptable to the Jersey Registry. It's a mathematical exercise calculating the Gross Registered Tonnage of the vessel and has nothing to do with its displacement. More like how many barrels of tar or tobacco it can carry. Bizarrely, you pay for this, but it's sent directly to the Registry. Please don't ask me why; I am clueless.

You will need several documents for the next stage. If you have registered through a company, then you will need copies of the following:

For the LLC, an original copy of the Certificate of Incorporation, including details of the beneficial owners of that corporate body and Articles of Association.

An original copy of Form JR05 - "Declaration of Eligibility/Appointment of a Representative Person" dated after the Bill of Sale or Proof of Ownership from the Yard.

The Builders Certificate can come from the Yard or use form JR03 - "Builders Certificate ." If from the Yard, it must contain all the information requested on JR03.

Proof of Ownership from the Yard. In Turkey, this is issued when the keel is first laid, i.e., you own the construction from Day 1.

A "Sanctions Letter" complying with the UK and EU Economic Sanctions and declaring that you are not Russian, like Vodka or an otherwise sanctioned individual or corporate entity.

Form JR25 contains a schedule of fees for this stage. They can be paid by card over the telephone and are very reasonable.

The last act

Complete all the above, and you are nearly there. The final stage is to attach the name and Port of Registry (Jersey) in a way compliant with the requirements of:

Form JR10- "Ships Carving and Marking Note."

The Jersey Registry will send this form to you for completion. The name and Port of Registry are affixed to the Stern and Tonnage Plate to some substantial hull members. Take photographic evidence of this and send it back to the Registry.

Under US Coast Guard's purview, it is illegal to operate an unregistered tender when "carrying passengers or out of the line of sight of the mother ship". The largest British Channel Islands, Jersey is the most popular yacht registration port in the world. It is an independent jurisdiction. The island is governed by a separate "parliament" of Jersey, while, at the same time, it is subordinate to the British crown when it comes to defense and foreign affairs. Jersey is an international financial center with a solid base. It is based on political stability, low taxation, and other favorable environments. The island frequently hosts commercial and private pleasure yachts up to 399 GT, based and used anywhere in the world.

Who is allowed to register a yacht in Jersey? It can be done by companies and individuals who are members of the Commonwealth of Nations, the European Union, and other territories, who have full rights to register water transport. A particular advantage of registering in Jersey is the ability to issue a temporary registration to cover shipping after a yacht deal has been closed. Jersey is not subject to the EU VAT in financial matters. Therefore non-EU owners who want to work in Europe without VAT and have the full right to temporary exit (import) following benefits.

Commercial Yacht Charter Registration

To use your yacht commercially in Greece and the rest of the EU is the optimal registration option at no extra cost. In this situation, you don't even need to create a company in Greece. This commercial vessel registration package contains everything you need to conduct a charter business. It is based on the widespread registration of commercial yachts in Poland.

Greece boasts a fairly developed charter industry in the EU. At the moment, it is showing an excellent package of charter licenses from all members of the European Union. This package is based on the Polish registration of commercial yachts. The Greek authorities have complexly officially accepted this registration package. It can be used by all vessels that are not more than 24 m in length.This commercial registration is valid not only in Greece. It is relevant throughout the EU.

Polish Yacht Registration (Pleasure and Commercial)

Pre-registration is issued after 48 hours, after which you can use it. If the boat is less than 24 m long - the Polish Boat Register is the best solution for registering water transport. In this situation, you can register a yacht, boat, or jet ski in Poland, having received a lifelong document without the need to renew it. Poland is a full member of the EU. Therefore, boat registration on the territory of this country is popular among private yacht owners, charters, operators, and pleasure boats.

Starting in 2021, citizens of non-EU countries have the right to register a Polish boat for themselves. As a result, the cost of paperwork is reduced and there is no need to wait long for all operations to be carried out. Yacht owners are not required to inspect the vessel, which saves money. Also, one of the pluses of the Polish register is the receipt of a temporary registration for two days until the final registration finishes. As a result, you have every right to use the registration of a Polish boat almost immediately. All registration will be ready 3-4 weeks after the submission of the required package of papers.

It is for good reason that the British Register of Ships is the number one internationally valid title register for yachts.

The ‘Red Ensign’ flown by all British registered yachts is widely regarded as the flag of choice for the discerning yacht owner.

The British Register of Ships is divided into a number of separate shipping registries who collectively are known as the ‘Red Ensign Group’.

The Red Ensign Group is made up from the United Kingdom, the Crown Dependencies (Isle of Man, Guernsey and Jersey) and the UK Overseas Territories (Anguilla, Bermuda, British Virgin Islands, Cayman Islands, Falkland Islands, Gibraltar, Montserrat, St Helena and the Turks & Caicos Islands).

Any vessel registered in the UK, a Crown Dependency or UK Overseas Territory, is a “British Ship” and is entitled to fly the Red Ensign.

The registries forming the Red Ensign Group are divided into two categories:

Category 1 registers are capable of registering yachts of unlimited tonnage and type. Registers are:

Bermuda; British Virgin Islands (BVI); Cayman Islands; Gibraltar; Isle of Man; and United Kingdom.

Category 2 registers are capable of registering yachts and pleasure vessels of up to 150 gross tons (GT). This limit can be extended to 400GT with an agreement in place with the UK. Registers are:

Anguilla; Falkland Islands; Guernsey; Jersey; Montserrat; St Helena; and Turks & Caicos Islands.

What is the procedure to register a boat in Jersey?

The registration is easy and straightforward.

Bill passes to raise NJ gas tax 2 cents and add fee on EVs to fund roads, NJ Transit

The bill to renew the state Transportation Trust Fund is now awaiting Gov. Phil Murphy's signature after it cleared both legislative chambers Monday.

The back-to-back votes come just two weeks after the bill was introduced. It includes an annual 2-cent rise in the gas tax and a new registration fee for zero-emission vehicles to help fund state road projects and NJ Transit's capital needs.

The legislation was hurried through committees without amendments despite some concerns from Democrats and outcry from Republicans that no effort was made to seek bipartisan support.

Assemblyman Clinton Calabrese, D-Bergen, a sponsor of one of the bills and chairman of the transportation committee, said on the floor Monday that it was critical to pass the bill, which reauthorizes the fund for five years and increases potential borrowing to more than $15 billion, up from about $12 billion.

"Without such renewal, ongoing projects will languish, costs will skyrocket, reminiscent of the hardships endured during previous shutdowns that some of you may have been here to face," Calabrese said, referring to when the TTF expired in 2016 and capital projects around the state stopped for four months while then-Gov. Chris Christie and the Legislature worked out a deal to reauthorize the fund.

There was, however, some bipartisan opposition to the bill Monday, with three Democratic senators and five Democratic Assembly members representing districts in Gloucester, Burlington and Camden counties voting against it.

Sen. John Burzichelli, D-Gloucester, voted in favor of the bill during last week's budget committee hearing but warned there would be "ongoing work past this committee vote" and looked forward to "continued discussion on some of the finer points we talked about." He voted against the bill Monday.

Sen. Andrew Zwicker, D-Somerset, also voiced concerns at that hearing and wanted to see more discussion take place, but he voted in favor of the bill Monday.

"I’m very comfortable with the bill. We had a lot of discussion outside of today about looking holistically at electric vehicles," Zwicker said Monday, adding that there is more discussion taking place to refine policies around zero-emission vehicles.

Pushback from environmentalists and car sellers

Among the contentious parts of the bill that received pushback from environmental activists and car sellers is a new $250 registration fee for purchasers of zero-emission vehicles, on top of the regular registration fee for all other types of vehicles. This would amount to an additional $1,200 at the time of sale, because in New Jersey four years of registration fees are due at the time of purchase. Combined with Murphy's proposal to phase out the sales tax exemption on electric vehicles, this would significantly add to the sticker price and could lower the incentive among car buyers to go green.

"To do anything to discourage EVs in this state is a serious policy mistake," Sen. Bob Smith, D-Middlesex, said just before adding that he would still vote for the bill. "I’m hoping that in the budget negotiations we can talk to the front office and see if we can try to temper this a little bit."

Among the reasons the fees were proposed is to begin requiring zero-emission vehicles to pay into the TTF, which they currently don't do because they don't use gas and therefore don't pay the gas tax. That tax is considered a user fee for using the roads and goes directly into the fund that supports road and bridge repairs, expansions and improvement projects.

Though some see the registration fee for zero-emission vehicles as a way of their "paying their fair share," environmentalists testified that it's a "punitive" fee and other proposals should have been considered that would have mimicked a user fee, such as charging vehicles for electricity use at public charging stations or a fee for the number of miles traveled .

Neither of those ideas was included in the legislation, even as concerns rise nationally about relying on a gas tax to fund transportation projects as electric vehicle purchases rapidly increase.

For Republicans, the bigger unaddressed issues were about increasing another tax on New Jersey residents when budgeting alternatives could have been considered, like using surplus or debt defeasance to lower debt service obligations.

"Having the knee-jerk reaction to fix a problem by raising taxes has made New Jersey one of the worst-taxed states in the nation and made it completely unaffordable to our families," said Sen. Anthony Bucco, the Senate minority leader, from Morris County.

Five Republican Assembly members voted in favor of the bill.

Change of Ownership, Amending Registration or Full Registration

The vendor must complete a bill of sale and the purchaser must complete a declaration of eligibility.

If the vessel is to be company owned, a copy of the Certificate of Incorporation must also be provided by the new owner and an appointment of authorised officer form. These forms must be returned to the Ships’ Registry with the Certificate of Registry, a copy of your passport (if individual ownership) and the prescribed fee.

Following the death of a registered owner, contact the Ships’ Registry for personal service.

Changing the name of a vessel

If you want to change the name of your currently registered vessel, you must complete an application form for change of name, and return it to the Ships’ Registry with the Certificate of Registry for amending and the prescribed fee.

Applying for a duplicate / replacement Certificate of Registry

If you have lost your Certificate or if it has become illegible, you may apply for a replacement by completing an application form and paying the prescribed fee.

If the vessel is owned by a company the form must be completed by the current nominated authorised officer.

Change an address / engine / authorised officer / representative person / managing owner / other particulars

You must complete the appropriate form and return it to the Ships’ Registry with the Certificate of Registry and the prescribed fee.

There is no charge for a change of address for individuals.

Apply for a transcript / copy of the register

Write, telephone, fax, or email the request to the Ships’ Registry, detailing the vessel’s name or official number with the prescribed fee and a return address for receiving the transcript.

Apply for a certified copy of a document

Contact the Ships’ Registry with the name of the document required and pay the prescribed fee.

Personally inspecting the register

The register is a public register and is available for inspection during normal working hours. A fee must be paid upon inspection.

Transfer port from / to Jersey

For transfer from Jersey, you must complete a request for transfer of port form and return it to the Ships’ Registry with the Certificate of Registry and the prescribed fee.

You must also contact the new REG port of registry in order to follow their requirements.

For transfer to Jersey, you must complete an application to register form, a declaration of eligibility form, and provide a copy of the Certificate of Incorporation if it is to be company owned.

You will also have to contact the current REG port of registry and ask them to send the relative information to the Ships’ Registry.

Transfers may be made within any of the REG registries:

  • Isle of Man
  • Cayman Islands
  • British Virgin Islands
  • Falkland Islands
  • Turks and Caicos

Keeping the registration of a vessel in another jurisdiction and registering in Jersey

This is only possible if someone else charters the vessel from you whilst you remain the legal owner.

This is known as ‘bareboat charter’ and to all intents and purposes the first registration is put into suspension.

The charterer registers the vessel in his own name and whilst on the Jersey register it will be subject to Jersey law. Contact the Ships’ Registry for further information.

Close a registration

You may request closure at any time by completing the request for closure form and returning it to the Ships’ Registry together with the Certificate of Registry for cancellation and the prescribed fee.

Apply for a closed transcript / certificate of deletion​

Anyone may apply for a closed transcript / certificate of deletion by contacting the Ships’ Registry and paying the prescribed fee. There is no specific form to request this.

An Atlantic City man was indicted Tuesday in the boating incident that killed a 79-year-old woman swimming in the intercoastal waterway last summer, the Atlantic County Prosecutor’s Office said Wednesday.

Jeffrey M. Jastrzembski, 54, of Atlantic City, was indicted on first degree aggravated manslaughter charges after being initially charged by authorities in January.

Investigators said Jastrzembski had a blood alcohol level between .19% and .23% at the time of the incident near the Albany Avenue Bridge last summer.

At around 5:15 p.m. on Aug. 12, 2023, Jastrzembski accelerated the boat he was operating toward the docks and aggressively turned to left causing the propeller to hit and kill Norma Michaels, 79, of Atlantic City, authorities said.

An attorney for Jastrzembski was not immediately reachable Wednesday for comment.
