Berthon Spain

Berthon Spain is a yacht refit, repair and maintenance company with a brokerage office in Palma de Mallorca. We offer a bespoke yachting service to the Mediterranean yachting community, combining yacht technical support with yacht brokerage.

Yacht Refits & Services

Berthon Spain’s expert team have successfully completed countless projects on a variety of size and type of vessels. The wide ranging skill sets available at Berthon Spain permits us to keep the majority of the work in-house, allowing us to keep full control over the project’s budget, timescale and quality of the work delivered. Our services include: Engineering, Electrical, Antifouling, Hydraulics, Fabrication, Plumbing and Guardiennage.

Yacht & Tender Storage

Berthon Spain have a custom built facility in Son Oms, a short drive from central Palma and close to Club Nautico S’Arenal. The 2000m2 warehouse is capable of storing yachts, up to 20 metres, looking to escape the winter weather and Palma’s high mooring costs. Within the facility we can also securely store, service and refit superyacht tenders, RIBs and jetskis.

At Berthon Spain we understand the importance of good communication and efficiency for the successful management of your yacht. With years of experience between us, we have the knowledge and know-how to assist in every aspect of day to day operations as well as broader refit and maintenance projects. Our services and products, gearbox repair.

We are the authorized service dealer for the German manufacturer REINTJES who, besides ZF and Twin Disc, is among the most important suppliers for the superyachts. Our team has many years of experience, which means that we as specialists are able to carry out repairs and overhauls on site or at our workshop. Using a professional borescope allows us to do internal inspections with detailed reporting including pictures. with detailed reporting.

Generators / Gensets

We are the official service partner for ZENORO marine generators. Using high-end components and smart design they are the silent beating hearts of all comfort, security and reliability aboard the finest yachts in the world. ZENORO designs generators with access for maintenance, allowing maintenance engineers the space they need to work. Appearance is part of the yachting world. ZENORO enclosures are characterized by superb finishing, smooth surfaces and finished in every colour. They have integrated XEAMOS exhaust aftertreatment systems for a yacht environment compliant with IMO Tier III, for both refit and new build.

Steerable propulsion & Manoeuvrability

We are the authorized dealer(*) for the German manufacturer of steerable propulsion SCHOTTEL . The founder invented the rudderpropeller in which the company became the world leader owing to the high quality, reliability and the customer orientation. With these values, SCHOTTEL now has a selection of products with extremely low vibration and low noise levels for yacht propulsion including thrusters to aid manoeuvrability. Elastic couplings

We have the expertise of elastic couplings from brands such as Vulkan , Centa , Stromag or Rubber Design. Is your elastic element in need of replacement? We have the right contacts to deliver and change quickly. Early wear or damage? We can check the alignment.

Electric & Hybrid Propulsion

In 2008 the Italian propulsion specialist RTN started up their own brand ‘Auxilia Propulsion’ and supplied the first electric- hybrid propulsion system to Azimut-Benetti. Nowadays they have many more references that also feature full-electric systems. Auxilia Propulsion is an innovative electric propulsion system which fulfills the requirements and satisfaction of already a lot of owners, naval architects and shipyards with particular attention to the ecology, energy saving and comfort on board.

Acoustic enclosures

Noise control is an art. From extensive expert advice & design to assembly on-site and service. Alara-Lukagro has all the ingredients to make a project a success. In their production facility in The Netherlands they maufacture soundproof walls & doors, acoustic enclosures and silencers based on the exact wishes and needs of every customer. Alara-Lukagro is proud supplier of noise control for luxury yachts with an impressive reference list.

Exhaust Systems

TIO Yacht Exhaust Systems has been supplying for many decades both dry and wet exhaust systems to the world’s leading yacht builders for the main engines and the generator sets. They can manufacture silencers in nearly any shape and material meeting the highest noise and lowest exhaust back pressure requirements. TIO is also specialized in yacht exhaust system refits. They have developed partial silencers with a smart design that allows each part to pass through the narrowest door for assembly in the engine room.

Stabilizers

We are the dealer of the Dutch brand DMS Holland which, in addition to Naiad, Quantum, CMC, Wesmar and Vosper, is among the most important players in the field of external stabilizers. The owners of DMS Holland have both worked at Naiad. We are always able to select the right stabilizer for your yacht. We can also repair other brands or provide them with a new control unit which will upgrade your existing fin stabilizer system with soft zerospeed: the DMS Universal !

Stabilized Platforms

We are the Balearic dealer for STABLE AS , the Norwegian experts for custom made stabilized platforms and furniture on board of your yacht. A bed, a dining table, a sundeck, a wine cabinet, your fitness and yoga accommodation or spa, even a billiard table, … you name it and STABLE will give you the ultimate comfort by eliminating accelerations due to roll and pitch movements. STABLE platforms neutralize the movements of the sea!

Ship Automation

Praxis Automation Technology offers complete solutions in the ship automation, navigation and electric propulsion equipment field. They extended the Mega-Guard product line with electric propulsion and electric energy storage in order to show their commitment to environmental friendly propulsion. Praxis provides a total in-house developed and manufactured electric and hybrid propulsion solution for yacht owners and shipyards who care about the environment.

We are based in Palma, widely regarded as the main centre for yachts in the Mediterranean with a highly skilled workforce for all types of yachts, motorboats and superyachts. The island is approximately two hours flying time away from Europe’s main cities with regular direct flights into Palma’s International Airport.

Braemar Yacht Services expands in Palma

The superyacht surveyors add another hub to their worldwide portfolio of offices….

Braemar Yacht Services has opened a new office in Palma, Mallorca. The Palma office will be based at the Astilleros de Mallorca shipyard. This location joins the many offices across the globe, including London, Hamburg, Rotterdam, Lisbon, Dubai, Singapore, Hong Kong, New York, Miami, Seattle, Panama and Melbourne.

Richard Franklin, head of Braemar Yacht Services, spoke to SuperyachtNews to share his insight into the expansion. A key reason for the new office in Palma is to better serve clients and offer a rapid response when incidents occur. “When there is a fire, a flood or a collision, the underwriters need to have their surveyors on site as quickly as possible, to understand what has happened, to stop it from getting any worse, to work out what it is going to cost the underwriters and how to get the repair done, and to assist the captain through that process,” he says. “The clients expect us to be on-site very quickly.”

In addition to the need to be on-site quickly after accidents, Franklin explains that Palma was a natural choice for the company to open another office. “We have a number of ongoing large projects there, working as owner’s representation on major refits or major repairs. We have, at this moment, probably about three or four boats sitting at STP,” he offers. Palma, long established as a sailing yacht hub, also means that there is existing infrastructure to complement Braemar’s services. “Palma is the base for the world’s big sailing yachts. There is a huge amount of expertise and a number of contractors who are congregated in Palma and STP. So, obviously, we see a lot of the big boats there,” he adds. Looking ahead, Franklin reveals that Braemar are looking to expand further in the south of France, hoping to build a presence in Nice and Monaco.

The office at the Astilleros de Mallorca shipyard will be a base for Braemar’s surveyors, and Franklin says that the sheer capacity of the yard is a key reason for their offices to be situated there. “They are good to have as local partners, and we’ve worked with them a lot in the past. Astilleros de Mallorca can take the large yachts onto the slipways, and even bigger yachts alongside. Technically it’s a useful place to be.” The Palma office will be able to offer clients a number of services, including a full range of surveys (pre purchase, condition, pre risk and casualty surveys) sea trial supervision, owner's representation and project management for repairs and refits.

Business | south florida yacht brokers hit with lawsuits that claim 10% commissions violate antitrust laws.

Two newly filed federal lawsuits claim that 10% sales commissions required by South Florida’s yacht broker industry are anticompetitive and violate antitrust laws.

The claims follow an October finding by a federal jury in Kansas City, Missouri, that the National Association of Realtors conspired with brokers to artificially inflate commissions paid to real estate brokers. The ruling, and a March 15 settlement by the Realtors, is expected to radically change how homes are sold in the United States.

Both lawsuits involving yacht brokers name as defendants the International Yacht Brokers Association, based in Fort Lauderdale, the Yacht Brokers Association of America, Boats Group LLC and YATCO LLC.

Also listed as defendants in both suits are a who’s who of South Florida-based yacht brokers, including Denison Yacht Sales, MarineMax Inc., Galati Yacht Sales Inc., Allied Marine Inc., Tournament Yacht Sales LLC and Northrop & Johnson Yacht Ships, among others.

Nearly all of the defendants are headquartered in South Florida.

The most recent suit, filed on March 22, proposes a class of plaintiffs that includes anyone who listed vessels on certain Multiple Listing Services using a listing agent or broker affiliated with one of the defendants and paid a buyer’s broker commission since March 22, 2020.

The lead plaintiff in the lawsuit is Kip Lamar Snell, identified as an Alabama resident. Snell entered into an agreement with Galati to sell a 41-foot Express Cruiser Sea Ray in July 2020 and ended up paying a $12,000 commission on the $120,000 sale price, the suit states. The lawsuit lists as defendants 15 brokers and six organizations that promote the yacht trade or operate Multiple Listing Services.

That lawsuit follows one filed on Feb. 29 that proposes a class of plaintiffs that includes anyone who paid a commission to a listing broker affiliated with the defendants since Feb. 19, 2020. It lists as defendants 11 brokers and five organizations that promote the yacht trade or operate Multiple Listing Services.

The lead plaintiff in that suit is Ya Mon Expeditions, a Wyoming company that paid a “substantial broker commission” when it sold a vessel in January 2023 while represented by Tournament Yacht Sales of Tequesta.

The most recent complaint accuses the trade associations of colluding with brokers to “enforce an anticompetitive restraint that requires (sellers of pre-owned yachts and boats) to pay a brokerage fee to the buyer’s broker and a total aggregate commission fee that is inflated as a condition for selling their yachts.”

The complaint states the typical commission is 10% and is shared between the seller’s broker and the buyer’s broker under terms spelled out in Central Listing Agreements provided by the brokers associations, including the International Yacht Brokers Association and the Yacht Brokers Association of America.

Only boat brokers are able to list boats and yachts on such Multiple Listing Services as YachtWorld.com, BoatTrader.com and Boats.com, and the Multiple Listing Services will not accept listings from owners who want to sell their vessels themselves, the lawsuit states.

Yacht owners are “severely disadvantaged” if they do not list their boats for sale on the listing services, while buyers suffer because their brokers are “financially incentivized” to show boats that will earn them standard “and inflated” commission rates of 4% to 5% through co-brokerage transactions, the complaint states.

None of the defendants contacted for this story responded to a request for comment, and no response has been filed yet in either case.

Robert Allen Jr., whose Miami-based law firm Robert Allen Law represents the International Yacht Brokers Association, did not respond to emails or return a phone call.

A woman who answered the phone at the International Yacht Brokers Association said, “We have no comment on that,” and hung up after a reporter asked for her name.

Of six brokers contacted for comment about the lawsuits, only Tournament Yacht Sales responded to emails. “No comment,” the company’s response stated.

Overall commissions have increased faster than the rate of inflation in recent years as the price of larger boats and yachts have increased, according to the lawsuit that lists Snell as lead plaintiff.

The result is that boat owners pay “hundreds of millions of dollars” in inflated commissions each year, the suit alleges.

Both lawsuits allege violations of the Sherman Antitrust Act that are upheld by “brokers who should be competing with one another but, instead, cooperate with each other to the detriment of pre-owned boat sellers.”

Some brokerages represent both buyers and sellers and retain the entire 10% commissions, the suits state.

The trade associations enforce rules requiring brokers to offer their boats through a listing service and to share commissions, the suits state, adding that they can impose significant penalties on members who do not comply with their rules.

Yacht purchasers are disadvantaged by the current system, the lawsuit alleges, because their agents would otherwise negotiate for their business by decreasing their commission rates.

But buyer brokers’ commissions have remained constant despite their diminishing role, the suits state. Many buyers today find boats they are interested in purchasing through online searches and enlist the services of a buyer’s broker only after identifying the yacht they want to buy, the suits claim.

The lawsuits seek an order declaring the commission structure to be illegal, a permanent injunction outlawing what they describe as anticompetitive conduct, plus damages and/or restitution, pre- and post-judgment interest, and attorneys’ fees.

Paul Geller, an attorney for one of two law firms representing the class that includes Snell, acknowledged “parallels between the allegations relating to commissions in the real estate and yacht markets.”

In the real estate matter, the National Association of Realtors on March 15 agreed to a $418 million proposed settlement that would free home sellers from paying commissions to brokers for both sellers and buyers.

After a jury ruled for the plaintiffs in the case against the National Association of Realtors in October, numerous lawsuits were filed across the country with similar allegations, including one in December against the Florida Association of Realtors and 16 brokerages.

“At bottom, the goals of (the suit against the yacht brokers) are similar: protecting consumers by challenging what we allege to be anti-competitive conduct,” Geller said by email. “We believe in the universal truth that consumers benefit by increased transparency and the competitive pricing that results from negotiated terms, including commissions.”

Geller is a partner at Robbins Geller Rudman & Dowd LLP, which specializes in securities litigation on behalf of investors. The firm has offices in 10 cities, including Boca Raton.

“We are thrilled to collaborate once again with Red Yacht Design on the creation of the Aluna 92,” FDC Yachts director Eyup Ozbelen said in a statement. “Together, we aim to deliver a yacht that not only exceeds expectations but also redefines the very essence of luxury on the water.”

FDC says the Aluna 92 will be the first yacht in its class capable of accommodating helicopters. The vessel features a large touch-and-go helipad on the aft deck that can welcome large choppers capable of carrying up to four passengers, meaning that it can facilitate far more elevated comings and goings than its competitors. The aft deck is also equipped with a large lounge and an alfresco dining area for open-air soirees.

Other exterior highlights include a sprawling sundeck adorned with sunbeds and an expandable beach club with direct ocean access. FDC has also opted to include see-through bulwarks on some exterior decks to provide seafarers with panoramic ocean views.

The interior is equally as spacious and luxurious. The generous cabins can sleep up to eight guests, with the lavish full-beam owner’s suite transforming into separate cabins if additional accommodations are required. Such flexibility renders the Aluna 92 suitable for charter.

“We are confident that the Aluna 92 will exceed the expectations of even the most discerning yachtsmen,” added managing partner of Red Yacht Design Faith Surekli.

FDC says construction on the first Aluna 92 is scheduled to commence by the end of this summer.
