Spinnaker Island, also known as Spinnaker Island & Yacht Club is an innovative 103-unit condominium complex on Spinnaker Island. This resort-style, beachfront community was created in the mid-1980s to help solve the problem of Boston's housing crunch. These spectacular condos were designed to smoothly blend with houses in the neighboring towns of Boston Harbor's South Shore. In an effort to mimic traditional New England styles, they have sharply sloped roofs, paned bay windows, and gray, weathered-looking shingles. These units are approximately 1,700-1,900 square feet, give or take, and are in the range of $300,000 to $350,000.

The townhouse-style units at Spinnaker Island have two or three bedrooms, depending on the floor plan. They have a gorgeous living room with gleaming hardwood floors and a fireplace to cozy up around during a cold New England winter night. The living room has oversized windows with stunning views of the beach. The windows brighten the entire room with sunlight. A sliding glass door opens up onto a private deck that's the perfect place to unwind after a long day while listening to the waves crashing on the shore.

Spinnaker Island's condos have a stunning eat-in kitchen with a built-in desk area underneath two large windows. A center island is big enough to sit three people. The kitchen has beautiful countertops, cabinets galore, and sleek stainless steel appliances. The master bedroom has vaulted ceilings, a ceiling fan, and - you guessed it - even more big windows. Occupants can watch the sun rise or set over the ocean from their bed.

Amenities on Spinnaker Island include an L-shaped swimming pool and a barrier beach. Each unit has a one-car garage. Spinnaker Island is less than half a mile off of the south side of the Nantasket peninsula in Hingham Bay. A 300-yard man-made causeway connects it to the mainland. The marina accommodates roughly 69 boat slips, which are owned by non-unit owners and unit owners. Boat slips can be purchased for an additional cost. Residents also have access to the commuter boat to Boston.

Once known as Hog Island, the island now known as Spinnaker Island lies south of Point Allerton, Hull in the Northern section of Hingham Bay. Today, the island is connected to the mainland via a long causeway. The island was renamed Spinnaker in the late 1980s when it was purchased by a developer and turned into condominiums and a marina. Pictured below is a south-looking view of Spinnaker Island as seen from the top of Fort Revere in Hull:

Like most of the other Boston Harbor Islands, Hog Island was once used for military operations. Remnants of the island’s fortifications at Fort Duvall are still visible around the modern residential buildings on the island. It has been said that the battery casemate at the Fort was too difficult to demolish, so instead it was kept in place and built around. This is not surprising when considering these fortifications were built to withstand an enemy attack.

The wartime operation of Hog Island certainly impacted civilian life around the town of Hull. This was particularly documented by an article* describing one afternoon in September 1942, when the guns at Fort Duvall did a practice drill, firing massive 16-inch shells at targets offshore. More than two thousand residents of Hull had to be evacuated for the drill, and many residents returned to find windows that were shattered by the force of the blasts. Thankfully these big guns never had to be used, but they were certainly ready to defend the City of Boston in the event of a coastal invasion.

Following the end of WWII, Fort Duvall was decommissioned, and its space was used as the fire control and radar system for a nearby NIKE missile system located on Weymouth Neck (what is now Webb Park ). Pictured below is a view from Spinnaker Island of the narrow neck of Hull, with the Brewsters in the background:

Below is a view of the sunset over Spinnaker Island. This view, looking southwest from mainland Hull is taken from a location near the Hull Yacht Club. Spinnaker Island provides a natural barrier around the area of Allerton Harbor protecting the docks and moorings at Hull Yacht club from more open water. However, boats transiting this area must beware of the long shallow bar which extends east from the southeastern end of Spinnaker Island. Below one can see Spinnaker Island to the left, the long causeway in the center, and the silhouette of Blue Hill in the distance. Fort Revere’s water tower is visible to the right, protruding from the top of Hull’s Pemberton Point.

Glad they saved Fort Duvall. Too bad the MWRA couldn’t have kept at least the 90mm battery at the end of Deer Isle. There was no reason to tear that up. nothing there now. History gone.

Where reserved expansion parcels of a condominium development constituted part of the common area of the condominium, the parcels were not subject to real estate taxation by virtue of the exclusion set forth in G. L. c. 183A, s. 14. [22-24]

Kass, J. This is the first of two cases that consider whether municipalities may tax rights retained by the declarant of a condominium (developer) to build additional phases of the condominium [Note 1] . Here, the assessors of Hull assessed real estate taxes to Spinnaker Island and Yacht Club Holding Trust (taxpayer) for fiscal year 1996 and 1997, as owner of ten parcels of land (expansion parcels) on Spinnaker Island [Note 2] . The Appellate Tax Board (board), after proceedings under its formal procedure [Note 3] , decided that the expansion parcels were part of the condominium's common area as defined by G. L. c. 183A,

s. 1, and as such, were exempt under G. L. c. 183A, s. 14, from assessment as separate parcels of real estate.

1. Facts. By master deed dated January 16, 1985, and recorded with the Plymouth Registry of Deeds, the developer [Note 4] submitted all of Spinnaker Island to the provisions of G. L. c. 183A, the condominium enabling law. See G. L. c. 183A, s. 2. The master deed described a condominium consisting of twenty-two units in ten buildings. That was to be Phase I of the condominium.

Under s. 6 of the master deed, the declarant reserved the right, at its sole option, to increase the size of the condominium in phases, to a limit of 103 units [Note 5] . Section 7 of the master deed, captioned "phasing lease," speaks of a lease of the land - on which the additional phases are to be built - that the declarant has "entered into," although it neglects to say with whom or how long the lease shall run. Whenever the declarant built an additional phase, the lease automatically terminated as to the land incorporated in the new phase of the condominium. There is no evidence that any "phasing lease" was ever executed and, as we shall see, there is some evidence that it never was. Details of the developer's option to add to the condominium are further set out in s. 14 of the master deed, dealing with amendments to that document. Among the limitations that appear in s. 14 is that the developer's right to increase the size of the condominium by building additional units expires January 1, 2004.

In 1985, the declarant added twenty-five units to the condominium; in 1986, thirty-three units; and in 1988, four units. There were then eighty-four units in the condominium. For five years the condominium did not grow further; the real estate boom of the late 1980's had run out of steam. On January 20, 1994, the developer [Note 6] assigned all residual development rights to the taxpayer, a nominee trust of which the sole beneficiary was the condominium unit owners' organization (see G. L. c. 183A, s. 10), Spinnaker Island and Yacht Club Association.

That instrument of assignment, which bore the caption, "Quitclaim Deed," refers to the phasing lease "to the extent such Phasing Lease is existent," thereby reinforcing doubt that a phasing lease was ever drafted, let alone signed [Note 7] . Six months later, on June 15, 1994, the taxpayer executed and recorded a document by which it relinquished development rights in eight parcels of Spinnaker Island, but retained rights in ten. Those ten parcels make up the expansion parcels that the town has undertaken to tax. At the time the taxpayer reduced its development rights to ten parcels, the unit owners amended the by-laws of their condominium association to provide that the management board of the association could authorize the addition of units to the condominium only with the consent of the holders of at least sixty-seven percent of the beneficial interests in the unit owners' association.

2. Discussion. The theory on which the assessors in this case claim to be able to tax the development rights owned by the taxpayer is that those rights were real property. See G. L. c. 59, s. 2A(a) [Note 8] As the assessors see it, the rights appurtenant to the expansion parcels separated them from the common. area of the condominium. In view of the real estate labels used by the developer in dealing with the retained development rights, one may imagine why the assessors were tempted to regard those rights as taxable real property. First there was the phasing lease, and second there was the instrument of assignment of development rights to the taxpayer, which was cast in the form of a quitclaim deed and was expressly so captioned [Note 9] . Labels, however, may not camouflage the underlying reality. See Commonwealth v. Beneficial Fin. Co., 360 Mass. 188 , 292 (1971), cert. denied sub nom. Farrell v. Massachusetts, 407 U.S. 910, and sub norm. Beneficial Fin. Co. v. Massachusetts, 407 U.S. 914 (1972); American Trucking Assn. v. Secretary of Admn., 415 Mass. 337 , 342 n.9 (1993); Tinkham v. Department of Pub. Welfare, 11 Mass. App. Ct. 505 , 512 (1981); Cumberland Farms, Inc. v. Montague Economic Dev. & Ind. Corp., 38 Mass. App. Ct. 615 , 621 (1995).

General Laws c. 59, s. 2A(a), as appearing in St. 1979, c. 797, s. 11, provides that "[r]eal property for the purpose of taxation shall include all land within the commonwealth and all buildings and other things thereon or affixed thereto . . . ." By the terms of s. 1 and schedule A of the master deed, all the land of the island is submitted to the condominium. Under G. L. c. 183A, s. 1, the declarant of the condominium could have done no less, as that statute defines "common areas and facilities" of the condominium as including the land on which the condominium buildings are located. We read the statute as referring to the land dedicated to the condominium rather than the footprint of a particular building. Section 4 of the master deed confirms that the common areas and facilities of the condominium shall include "all areas and facilities of the [c]ondominium as are not within a unit of the [c]ondominium."

Once it is recognized that the expansion parcels constitute common area of the condominium, it follows that they are not subject to real estate taxation because G. L. c. 183A, s. 14, as appearing in St. 1963, c. 493, s. 1, provides that "common areas and facilities . . . shall not be deemed to be a taxable parcel." This does not mean that the land of a condominium escapes taxation. "Each unit and its interest in the common areas and facilities shall be considered an individual parcel of real estate for the assessment and collection of real estate taxes." Ibid. That is, the assessors may factor common areas and facilities into the value of an individual condominium unit to be taxed but may not tax them separately. If retained condominium development rights are to be taxed, as we shall discuss more fully in the First Main St. Corp. case, post at 29-30, the Legislature shall have to act.

As to the phasing lease, apart from its peculiarly ephemeral quality, even had it existed, the arrangement as described did not purport to give possession to another but was a reservation of right to use common land for additional condominium units, the land under which would continue to be common area. See DiBiase Corp. v. Jacobowitz, 43 Mass. App. Ct. 361 , 364-366 (1997), S.C., 427 Mass. 1004 (1998).

Two cases that stand for the proposition that the statute does not preclude establishing nonownership interests in condominium land are not of assistance to the assessors. Commercial Wharf E Condominium Assn. v. Waterfront Parking Corp., 407 Mass. 123 , 125 (1990),

involved retention by the developer of an easement in a driveway and parking area before declaration of the condominium, i.e., the real estate was withheld from the common area. Similarly, in Beaconsfield Towne House Condominium Trust v. Zussman, 416 Mass. 505 , 506-508 (1993), the execution of a 155-year lease (of twelve parking spaces) executed and recorded prior to the master deed excluded the parking spaces concerned from the common areas and facilities of the condominium. In the instant case, there has been no exclusion of land from the common areas.

By reason of the unambiguous exclusion in G. L. c. 183A, s. 14, of common areas from taxation except to condominium unit owners in proportion to their percentage interests, the expansion parcels are not subject, as separate parcels, to real estate taxation. The decision of the Appellate Tax Board is affirmed.

So ordered.

[Note 6] Through a series of assignments, the development rights had devolved upon Spinnaker Island, Inc.

[Note 7] The Appellate Tax Board remarked in its decision that the assessors had "failed to prove the existence, let alone the terms, of the phasing lease." No phasing lease was offered in evidence.

Royal Palm Yacht & Country Club

Founded in 1959, the club has been part of the Boca Raton landscape for over 50 years with membership by invitation only. The state-of-the-art Marina boasts a TimberTech floating dock system, accommodating vessels up to 130 feet. 

Sailfish Club of Florida

The Sailfish Club of Florida was built in the early 1900s. It is the oldest continuously operating private club in the town of Palm Beach.

San Diego Yacht Club

In June of 1886 a group of local boating enthusiasts joined together to found what has become this cornerstone yacht club. The racing history of SDYC is as significant as the history of its location. Several members were winning races all over the country in the early to mid-20th century, however, SDYC reached a turning point starting in the 1980s when Dennis Conner won the America’s Cup. In the early 1980s, Dennis Conner won the cup once and then lost it the next time to New York Yacht Club. In 1987, Dennis won again on behalf of San Diego Yacht Club. The America’s Cup was won a third time by SDYC in 1992 by Bill Koch on the yacht,  America .

With 600 wet slips and 100 dry slips, initiation fee is upwards of $24,000 plus $200 monthly dues.

In the summer of 1869, a group of active, local yachtsmen formed the San Francisco Yacht Club. The oldest yacht club on the Pacific Coast, it’s one of the most elegant and exclusive yacht clubs in the U.S. The harbor consists of 190 berths and 50 dry-storage spaces, as well as a large youth sailing dock. Membership is by sponsor referral only.

Sarasota Yacht Club

Sarasota Yacht Club was organized in the summer of 1907 and located on the north end of Siesta Key. Facilities include a 110-slip marina, fitness center, heated pool, two indoor bars, a pool bar, multiple meeting rooms, a grand dining room, waterside terrace, and lunch dock. Membership is by invitation only.

Savannah Yacht Club

The Savannah Yacht Club was originally organized on June 14, 1869. The private, members only club is by invitation only with only 1,000 members. Amenities include a figure 8 pool, an Olympic size swimming pool, as well as floating docks.

St. Francis Yacht Club

This club was founded in 1927 when the members of the San Francisco Yacht Club decided to move their clubhouse out of San Francisco to Belvedere, California. The 2,300 member club is considered to be the most prestigious yacht club in the western U.S. and has hosted over 40 regattas on San Francisco Bay. The Mediterranean Revival-style clubhouse is in close proximity to the Golden Gate Bridge and enjoys views from the Bridge to Alcatraz Island and beyond.

Tampa Yacht & Country Club

Founded in 1904 as a place to race sailboats, ride and show horses, the marina now holds 31 covered slips and 50 open slips. Membership is sponsored and by invitation only.

Sometime in the early 1600s, sailing for private pleasure started to to become popular in the Netherlands. Later that century, during the Cromwellian years, King Charles II of England was in exile in the Netherlands and while there he became aware of this new and exciting pastime. According to Royal Cork Yacht Club, “By 1720, interest in the sport had progressed so much that his great-grandson, the 26 year old William O’Brien, the 9th Lord Inchiquin, and five of his friends got together to formalize their activities and in so doing established ” The Water Club of the Harbour of Cork.”

This club is known today as the Royal Cork Yacht Club and it is the oldest yacht club in the world. It was originally located on Haulbowline Island before moving to the town of Cobh and finally establisged in it's current location in Crosshaven.

Founded by Prince Rainier III in 1953, the Yacht Club De Monaco is a prestigious club that holds a unique position on the international yachting scene with more than 1600 members drawn from 66 nationalities.

The reigning Club President since 1984 has been His Royal Highness, Prince Sovereign Albert II, and a suitably formal dress code for day and evening wear is enforced at all times. Membership is limited and very, very exclusive: prospective candidates must submit an application form to the club committee and be introduced by two sponsors, both of whom must be existing members. The successful applicant will be welcomed with an ice-breaking cocktail party and gala dinner in their honor.

The futuristic clubhouse was redesigned in 2013 and overlooks Port Hercules, it offers up very popular cocktail bar and Mediterranean restaurant.

Established in 1927, the Manila Yacht Club and Marina is one of the oldest yacht clubs in all of Asia, and is nestled in the scenic Manila Bay. It is also near other well-known landmarks in the city, such as the Cultural Center of the Philippines (CCP), the headquarters of the Philippine Navy, and the US Embassy. Facilities in the marina include a launching ramp and a fueling center, and the club itself is host to a restaurant and gorgeous function rooms. The Manila Yacht Club only welcomes visitors who arrive by boat, and it charges an initial security deposit of USD 750 upon arrival. Club membership is mandatory for medium and long-term mooring of boats.

Subic Bay Yacht Club, Zambales

The Subic Bay Yacht Club, which was founded in 1998, upholds itself as the country’s premier yacht club. It operates in the deepest bay in the country, and can host vessels well beyond 50 meters in length. Already benefitting from the innate beauty of the Zambales mountains surrounding it, the club hosts a number of other attractions, including its luxury accommodations, swimming pools, and its own movie theater, bowling alley, and nightclub. Those who venture outside of the club’s premises can also shop for well-priced imported goods at the Subic Freeport Zone, engage in water sports , or sign up for diving excursions.

Punta Fuego Yacht Club, Batangas

Peaceful Punta Fuego is a mecca for those who love the sport of sailing. As per its official website, the Punta Fuego Yacht Club aims to serve “a dynamic and vibrant community of boat enthusiasts and yacht owners.” This it does by playing host to a diverse population of watercrafts, from large catamarans and mono-hull yachts to small boats. Non-members of the club may use the berths for up to 3 weeks, and can refuel at the marina’s fueling station. The yacht club offers other amenities such as locker rooms, shower rooms, Internet facilities, a chart room, and a restaurant called Barracuda Bar, which serves delicious fares. Outside of the yachting crowd, Punta Fuego Yacht Club also caters to those wishing to celebrate weddings, conferences, and corporate events in their opulent quarters.

Puerto Galera Yacht Club, Oriental Mindoro

Further south, yachtsmen may moor at the Puerto Galera Yacht Club in Oriental Mindoro, an island location that’s home to tourist attractions like the Sabang Wreck dive site, lively beachfront resorts, and the Malasimbo Music Festival. Puerto Galera Yacht Club has been in operation for almost thirty years and lends services such as refueling provisions and yacht repairs from its marina. Boat owners also enjoy optimal convenience if mooring here, as they can also shop for spare parts in the nearby Batangas port.

Busuanga Yacht Club, Puerta del Sol Bay Marina, Palawan

Cebu Yacht Club, Mactan Island, Cebu

The historic Mactan Island in Cebu was the site of Portuguese explorer Ferdinand Magellan’s arrival in the Philippines. Now known as a commercial hub that hosts a prolific furniture and musical instruments industries, Mactan is also the location of the Cebu Yacht Club, an institution that is beloved by the locals. Aside from being an ideal spot to restock on much-needed fuel and supplies, the Cebu Yacht Club is also a trusted club to commission for boat repairs. The space is quite roomy, in fact, with 56 berths that can fit vessels up to 15 meters in length. The club also has a boat ramp that can accommodate boats up to 18 meters in length. The well-guarded and weather-safe marina is a gateway to some of Mindanao’s finest attractions, such as the Pearl Farm, Hagimit Falls, and Giant Clam Sanctuary.

Pleasantly surprised, service is good so is the food. Great selection of Fusion food, a mixture of Italian, Japanese, European, Asian etc. A pleasantly nice dining experience, highly recommended, a must try!

Best food, best view in Moscow. absolutely faultless from arrival to finish. Best risotto i had for many years absolutely perfectly cooked. The view on Ukrainian hotel and the white house by night is amazing

Had to wait for the food for 1.5 hours and then another 20 minutes for the check. Finally called for the manager and he offered... a 10% discount as a compensation. Simply pathetic! The food is mediocre at best. Not bad per se, but one... would expect something better considering the prices. There are many places to eat in area that are much better. Avoid this one at all costs. Food is very expensive,very pretentious, doesn't worth that money. Portions are very small. We ordered ravioli and there were 4! Four raviolis! For almost 15 euros. Then we asked to bring us dessert menu but nothing, they didn't even bothered, so we payed and left... without dessert. Very poor service for that price. More

This is a very good restaurant. The food is really good, maybe the best in Moscow. The service is also good. The view from the restaurant is great. The prices are very high.

I often visit this restaurant and must say it’s one of the best in Moscow in terms of quality and service. Staff really try hard to make sure that you are happy and satisfied. Customer service is a huge problem in Moscow but Chaika sets... a great example for others in the industry! Food is delicious and the menu has lots of options for everyone! Visited this lovely restaurant with a friend of mine. It was relaxingly warm August evening - so the place on the river seemed like a good idea. We came quite early and the restaurant was not full. The hostesses kindly offered several places to sit... and we chose to sit on the sofas. We had some wine, which was good. We struggled a bit when deciding about the food as few options (scallops) were not available. Fish on ice on display did not look very fresh. To be honest it was an unusually hot August and it is probably understandable that some see food options were not available. However, we did manage to order something and sat waiting and looking onto the river. My long-legged friend struggled sitting at the low sofa and the manager noticed that, offering as a very good, proper table beside the open window. It was nice touch and I was very pleased by their polite observations and immediate reaction to solve the problem. Food was quite good and presentation was perfect. Perhaps I can something about the food, but 1 visit is not enough to criticize or make a definitive opinion. Overall, quality place, which of course, does not come cheap. I would recommend this restaurant without hesitation. More

The luxurious atmosphere of this place, the view and the location make it quite outstanding. We had dinner here with friends and the dishes were amazing, accompanied by a chilled bottle of Chablis, it really made me feel as if it was a part of... the classic Russian movie. More
