Why has ofac delisted yacht linked to russian fraudster and alleged cocaine trafficker tied to putin.

While OFAC, the Office of Foreign Assets Control, is a major player in the global fight against money laundering and sanctions evasion, sometimes its actions have me questioning its mission. The agency often releases individuals, entities and property from existing sanctions quietly, without any published explanation or reason.
While when circumstances arise that confirm that a sanctioned item is no longer affiliated with a certain already-sanctioned individual, it is appropriate to release the sanction, at other times I wonder aloud whether a specific delisting occurred as the result of behind-the-scenes lobbying in D.C. by powerful and influential law firms, who partners often include former US Treasury officials.
The press in Malta noted today that a SDN-sanctioned yacht, linked to Russian multi-millionaire (and PEP) SERGEI ADONYEV, a Russian financier, and himself under OFAC sanctions for his connections to Vladimir Putin, has been very quietly released. Adonyev, who reportedly was sentenced to thirty months in the US for fraud, and was deported at the conclusion of his sentence, was also allegedly linked to cocaine trafficking into Europe through St. Petersburg. The yacht was appropriately named ADDICTION, which speaks volumes about Adonyev's alleged activities.
Perhaps this is a good time for the Secretary of the Treasury to promulgate a regulation requiring OFAC to designate, with specificity, the precise reason a sanctioned individual entity or property is delisted. These actions, which take place out of the public eye, with no apparent oversight, remind me of sentence reductions given to individuals convicted in Federal court, which occur in total press darkness, and can only be found by reviewing a defendant's docket on PACER. We do not need government action with press blackouts, as it neither serves the public, nor the ends of justice.

Under the Malta Flag a yacht may be registered as a Private yacht or a Commercial yacht.
Private Registration
The Merchant Shipping Directorate considers a private registered yacht to be any pleasure yacht, of 6 metres in length or more, which does not carry passengers for reward and is not engaged in trade but is used for the sole purpose of the owner.
Commercial Registration
A commercially registered yacht is considered to be a yacht, of 15 metres in length or more, which do not carry cargo, carries not more than 12 passengers and operated by the owner or body corporate owning the yacht for commercial use.
The following classes of yachts will be considered for commercial registration:
Yachts in commercial use of not less than 15 metres in length and not more than 24 metres. Superyachts in commercial use of more than 24 metres in length and less than 500 gross tonnes. Superyachts in commercial use of more than 24 metres in length and 500 gross tonnes and over.
A commercial Yacht Code setting the required standards of safety and pollution prevention.
For Private or Commercial registration a technical survey is carried out on board to ascertain compliance with applicable regulations.
Surveys are performed by duly Appointed Surveyors.

Grand Harbour Marina
Perhaps the most well-known marina on the island, Grand Harbour Marina has given berth to some of the world’s biggest and most luxurious vessels. Situated in the picturesque surroundings of the Three Cities, it is flanked by limestone battlements and a promenade of exclusive restaurants and bars. It is also served by many high-end service providers for all your yacht's ancillary needs.
Marina di Valletta

Manoel Island Marina
The Manoel Island Marina is great for larger vessels as it can accommodate yachts up to 80m in length. Situated in Gzira, between Valletta and Sliema and a part of the Grand Harbour, it provides mooring services and is within a short walk of all amenities.
Kalkara Marina
Situated in the picturesque fishing village of Kalkara, the Kalkara Marina forms a part of the expansive Grand Harbour area. Levels of security are high, including electronically controlled gates, on-site security teams, and CCTV. All regular services, including concierge, repairs, and restocking, are available.
The procedure
Registering a yacht or super-yacht under the Maltese flag is available to all Maltese and EU citizens, non-EU entities, or companies incorporated in Malta or another EU member state. At CSB Group, we recommend that a Maltese company is the most appropriate vehicle for yacht registration.
You will then need to compile several documents, including the builder's certificate (if new), bill of sale, a survey certificate from a recognised surveyor, IDT for vessels of more than 24 metres, signed carving and marking note, and the deletion certificate from the previous registration.
Transport Malta will issue a provisional registration certificate within two to three days. This remains in force for up to six months while the process for permanent registration is underway.
It is advisable to work with CSB Group when registering under the Maltese flag. This makes the entire process much more straightforward and reduces the risk of any obstacles along the way. It also leaves you with more time to focus on planning your sailing itinerary rather than dealing with paperwork.
Tax and VAT benefits of registering in Malta
When you register your yacht in Malta, you can benefit from several favourable taxation provisions. These include:
- No income tax payable on a Maltese super-yacht owned by a Maltese company. Rather an annual tonnage tax is payable to Transport Malta based on the vessel’s net tonnage rather than earnings.
- In cases where a vessel does not qualify, income tax can be as little as 5% through Malta’s full tax imputation system.
- A high number of double taxation treaties with EU and non-EU countries;
- VAT exemption for commercial vessels for maintenance costs, fuelling, necessary supplies if the place of supply is in Malta and other criteria are met;
- There is no tax payable for a Maltese shipping company purchasing a yacht for commercial purposes. While 18% VAT will be paid upon import, this can be reclaimed. A further VAT deferment scheme is also available, subject to certain criteria;
- For yachts owned by a Maltese company, there is an opportunity to reduce the VAT impact when vessels are leased, resulting in VAT savings of up to nearly 13%.

- No restrictions on selling or mortgaging a Maltese registered yacht ;

- No restrictions on the nationality of crew, master, or officers on Maltese vessels;
- No trading restrictions on Maltese vessels;

The following documentation is required for registering a yacht under the Malta Flag. A yacht is first registered provisionally under the Malta flag for six months (extendible for a further period, or periods not exceeding in the aggregate six months) during which period all documentation needs to be finalised. The requirements for provisional registration are:
- Application for registration by the owner or an authorised representative, including, if required, application for change of name of yacht.
- Proof of qualification to own a Maltese Yacht; in the case of a body corporate, the document of incorporation.
- In the case of non-resident owners, appointment of a resident agent
- Where applicable, copy of the current yachts International Tonnage Certificate
- Declaration of ownership made in front of the Registrar by the owner or an authorised representative.
- For Commercial yachts of more than 24 metres, application for Minimum Safe Manning Certificate.
- Application for Ship Radio Station Licence.
- Compliance with Commercial Yacht Code for operational certificate.
- Payment of initial registration fees and annual tonnage tax.
The following documents are to be submitted during provisional registration:
- Where there was previous ownership, a bill of sale or any other document by which the vessel was transferred to the applicant for registry; otherwise a builders certificate in the name of the applicant.
- Where applicable, cancellation of registry certificate issued by the Administration where the yacht was last documented.
- In cases of commercial yachts over 500 gross tonnes, copy of the last updated Continuous Synopsis Record issued by the Administration where the yacht was last documented.
- Certificate of Survey and a copy of the International Tonnage Certificate issued by an Appointed Surveyor or Recognised Organisation.
- Evidence that the yacht has been marked in accordance with law.
- Where applicable, copy CE Marking Certificate.
Where valid appropriate convention certificates are not in place the yacht will be issued with a non-operational certificate of registry. A certificate of Malta registry is subject to renewal on the anniversary of the Maltese registration.
